Icac says it does not want the DPP to consider prosecuting Berejiklian, despite ‘serious corrupt conduct’ finding…

Plenty of corrupt conduct doesn’t quite meet the criminal standard. It’s one reason bodies like ICAC exist. In this instance, it seems like Berejiklian should have declared her conflict and recused herself from dealing with these grants. But did her relationship actually change how she acted on them? That’s harder to prove even if it was the case.

Edit: this page has info on the elements that constitute criminal misconduct

Edit2: oh yeah, ICAC also has coercive powers that allow it to get evidence that would be inadmissible in court. There’s probably a bunch of that here.

If her “deliberate … corrupt conduct” doesn’t meet the standard, in my eyes that means the standard is too high.

No no no. You see she’s being a GIRLBOSS and GATEKEEPING the patriarchy from the halls of power. She’s a feminist icon for GASLIGHTING the ICAC, you can’t lock her up! It’d be a horrible example to all the little girls out there.

The fact that she’s 3 premiers ago shows how slow and underfunded the NSW ICAC is. How is the speed of this process in any way useful to the Australian public or to her party, who should decide by it whether or not to oust her. It’s a farce. It exists but has no effect. I guess that’s how the LNP like all their public offices. I hope a national ICAC works well and provides a better framework by which state ones should set themselves to
